Terms and Conditions
All terms are subject to change at any time without notice. In accordance with the terms and conditions set forth herein, I agree to join Club Spa Membership at The Best Day Spa for a minimum of six (6) months. Upon signing this contract, I hereby acknowledge that I have read this contract and has not relied upon any promises, statement or representation other than as contained herein and hereby acknowledges receipt of a copy of this agreement:
PAYMENT TERMS: A valid credit card not expiring in the next six (6) months is required. Membership fees cannot be paid by cash, check or an HSA card and cannot be pre-paid ahead of the due date or month. Your monthly membership payment will be due on the signup date and then due on or after the same day of each month, specified above as the monthly billing start date (either 1st or 15th of each month). Your initial membership is for the term specified above (either 6 months or 12 months). Upon resuming a membership after a suspension or cancellation, renewed members must complete the 6-month term. Following the initial term, your membership will automatically continue on a month-to-month basis until you cancel your membership with 30-day notice in writing. Terminated Members: If a credit card is declined or automatic payment does not go through, a member must call the spa within three (3) months to update your credit card. After three (3) months of non-payment, such member(s) will be terminated and lose any remaining credit(s) at that time.
CANCELLATION: Memberships and series purchases are non-refundable under no circumstances. The Best Day Spa reserves the right to cancel the contract if you demonstrate inappropriate behavior towards any employee or staff of The Best Day Spa. Early Termination: This contract may be cancelled within 30 days of signing-up. After 30 days, you may not cancel your membership under no circumstances. In the event of an early termination, you will be billed for the full price of all services rendered as a member or for $100 early termination fee. Cancellation After Initial Term: Cancellation requests are not retroactive. 30-day notice of cancellation is required. All cancellation requests must be submitted in writing online or via email to firstname.lastname@example.org. Payments due prior to the effective date will be charged as scheduled. Membership-for-Two Cancellation: The credit card holder on the membership-for-two account will keep all accrued member credits in the event of divorce or separation and may designate the recipients of member credit gift certificate(s) if not used by the member him/herself.
ACCRUED CREDITS: No refund will be given for any unused member credit(s). Active/Current Members: You have the entire initial and renewed term of the membership to use all membership credits. You may continue to redeem your membership credits as long as your membership is in effect and is current. Suspended Members: To use up your stockpiled membership credits, you may put your account on hold for three (3) months after your last membership billing date. If you do not resume your membership or your credit card on file declines after three (3) months of inactivity and non-payment, all accrued membership credits will expire and be forfeited at that time. Inactive/Cancelled Members: Upon cancellation of your membership, all unredeemed membership credits will expire three (3) months after your last membership billing date.
CREDIT SHARING: You may give away your Member Credit to anyone as long as you accumulated at least two Member Credits. Gifting of Accrued Credit(s): If you are unable to use your member credits yourself for any reason, you may gift unused member credits to friends and family in a form of member credit gift certificates. The member credit gift certificate from an accrued member credit will expire in three (3) months from the issue date. You must be a current/active member for the issued member credit gift certificates to be valid.
APPOINTMENTS: You may cancel or reschedule an appointment with no charge over 24 hours preceding your appointment. To cancel or change your appointment, please call the spa directly. Late arrivals may result in a shortened appointment. Cancellation within 24 Hours / No Show: Any appointment cancellation with less than 24-hour notice or no show will forfeit your member or series credit. If you do not have any credit left for the late cancellation or missed appointment, your credit card on file will be charged in full to pay for the service. Same-day cancellations will be charged in full regardless of any reason (including accidents, emergencies, or illness). You may obtain a full refund for the late cancellation or no show at the Spa Management discretion upon your submitting a physician’s written statement that you were unable to receive the scheduled treatment due to a sudden illness or a police report for an auto accident.
FORCE MAJEURE: The Best Day Spa shall not be liable for failure to provide services caused by labor disputes, strikes, war, fire, flood, accident, paper or other material shortages; or any act of God. In such case The Best Day Spa may extend the time for completion of Agreement or credit a prorated amount to you in its sole discretion.
